Terms of service

1. Agreement

By creating a MkulimaOS account or using the service, you agree to these terms. If you are signing up on behalf of a farm or cooperative, you confirm you have authority to bind that organisation.

2. The service

MkulimaOS provides software for farm management — tasks, workforce, agronomy, finance, and EUDR compliance. Features listed on the pricing page are included based on your plan.

3. Your responsibilities

  • Keep your login credentials safe. You are responsible for actions taken under your account.
  • Only upload data you have the right to upload.
  • Do not use the service to break the law, send spam, or harm others.

4. Fees

Fees are listed in Kenyan Shillings on the pricing page. Annual plans are billed up front. Monthly plans renew automatically. You can cancel any time from Settings → Billing; no refunds for the current period unless required by law.

5. Data ownership

Your data is yours. We hold it only to operate the service. You can export it at any time; on cancellation we delete it within 90 days (see Privacy policy).

6. Service availability

We aim for 99.5% uptime on the Professional plan and 99.9% on Enterprise (with an SLA). We do not guarantee uninterrupted service and are not liable for outages caused by third-party providers, force majeure, or planned maintenance we've announced.

7. Limitation of liability

To the extent permitted by Kenyan law, our total liability to you is capped at the fees you paid in the 12 months before a claim. We are not liable for lost profits, data, or indirect damages.

8. Changes

We may update these terms. Material changes will be emailed to account owners at least 14 days in advance. Continuing to use the service after a change is effective means you accept the new terms.

9. Termination

Either party can terminate for any reason with 30 days' notice. We can terminate immediately if you breach these terms (e.g. non-payment, illegal use).

10. Governing law

These terms are governed by the laws of Kenya. Disputes go to the courts of Nairobi.
